Welcome to Aquaculture Kings. These Terms of Service govern your access to and use of our website, and your purchase of products from us.

By accessing our website, placing an order, or clicking to accept these Terms at checkout, you agree to be bound by them. If you do not agree, you must not use our website or purchase from us.

1. About these Terms

These Terms apply to all website users, customers, and purchasers of Aquaculture Kings products, unless we have entered into a separate written agreement with you that states otherwise.

2. Website Content, Guides and Online Tools

Any calculators, dosing tools, salinity tools, water volume tools, guides, FAQs, product information, blog content, and other website content are provided for general informational and hobby use only.

While we take reasonable care in preparing website content, aquarium systems and user inputs vary, and errors or approximations may occur. You are responsible for checking all inputs, independently verifying results, and deciding whether any product, dosage, method, or recommendation is appropriate for your system.

To the extent permitted by law, Aquaculture Kings is not responsible for loss caused by inaccurate data entered by you, misuse of online tools, or reliance on general website content without appropriate independent verification.

3. Orders, Pricing and Availability

All orders are subject to acceptance and availability.

We may refuse or cancel an order before dispatch where reasonably necessary, including where:

  • a product is unavailable
  • there is an obvious pricing, listing, or description error
  • we reasonably suspect fraud or unauthorised activity
  • we reasonably believe the order would breach these Terms

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled order.

Unless stated otherwise, prices are displayed in Australian dollars and are inclusive or exclusive of GST as indicated at checkout.

Product descriptions, photographs, colours, packaging, and specifications may change from time to time. We do not warrant that your device display will perfectly reflect product colour or appearance.

4. Subscriptions and Pre-Orders

Subscriptions

If you purchase a subscription, you are committing to a minimum of 3 orders at the frequency selected at checkout. Any subscription pricing or discount is offered on the basis of that minimum commitment.

By placing a subscription order, you authorise Aquaculture Kings to charge your nominated payment method for each of the first 3 subscription orders, and for any further recurring orders unless and until the subscription is cancelled in accordance with these Terms.

A subscription cannot be cancelled during the initial 3-order minimum term. After the third subscription order has been processed, you may cancel your subscription before the next billing date.

If a scheduled subscription order has already been processed or dispatched, that order cannot be cancelled. Any return, refund, repair, replacement, or other remedy in relation to supplied goods remains subject to your rights under the Australian Consumer Law and our Returns Policy.

Pre-orders

If you purchase a pre-order product, you are purchasing a product before it is in stock or available for immediate dispatch.

We may take full payment, partial payment, or store your payment method at checkout and charge the balance at a later time before dispatch.

Unless the product page or checkout states otherwise, you may cancel a pre-order before it has been fulfilled. Once a pre-order has been fulfilled or dispatched, it cannot be cancelled for change of mind, but your rights under the Australian Consumer Law and our Returns Policy continue to apply.

Any estimated dispatch or availability date for a pre-order is an estimate only and may change.

5. Live Foods and Culture Products

Our live foods, including but not limited to phytoplankton, rotifers, copepods, and other zooplankton products, are supplied for aquarium use only and are not for human consumption.

By purchasing these products, you agree that you are not acquiring them for commercial propagation, reproduction, multiplication, resale, redistribution, supply, or competitive commercial use unless you have first obtained Aquaculture Kings’ prior written consent.

You must not, without our prior written consent:

  • culture, breed, propagate, reproduce, or multiply our live food products for commercial purposes
  • resell, redistribute, supply, relabel, or repackage our live food products for commercial purposes
  • commercially exploit any culture derived from, expanded from, or grown out from our live food products
  • acquire our live food products for use in competition with Aquaculture Kings

Aquaculture Kings may refuse sale, limit quantities, or cancel an order before dispatch where we reasonably believe the products are being acquired for unauthorised commercial propagation, resale, redistribution, or competitive commercial use.

6. Product Use

All supplements, additives, and cultureware sold by Aquaculture Kings are intended for aquarium use only unless expressly stated otherwise.

You are responsible for following all instructions, warnings, storage requirements, and usage guidance supplied with the product or published on our website.

Improper use, misuse, unauthorised modification, improper storage, or use outside the intended purpose may void any voluntary warranty or guarantee offered by Aquaculture Kings, but does not exclude any rights that cannot be excluded under law.

7. Intellectual Property

All Aquaculture Kings branding, product names, logos, labels, packaging designs, website content, text, graphics, photographs, videos, guides, layouts, and calculators are owned by or licensed to Aquaculture Kings and are protected by applicable intellectual property laws.

You must not copy, reproduce, republish, upload, post, transmit, distribute, adapt, modify, reverse engineer, create derivative works from, or commercially exploit any of our content, branding, or materials without our prior written consent, except as permitted by law.

These Terms do not transfer any intellectual property rights to you.

8. Prohibited Conduct

You must not:

  • misuse, disrupt, damage, or interfere with our website or its operation
  • use our website, products, or content in a misleading, unlawful, fraudulent, or harmful way
  • misrepresent any affiliation with Aquaculture Kings
  • use our live food products or derived cultures for unauthorised commercial propagation, resale, redistribution, or competitive commercial use
  • relabel, repackage, or market Aquaculture Kings products or derived cultures as your own without our prior written consent

9. Consumer Rights, Returns and Refunds

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Our Returns Policy applies in addition to these Terms, to the extent it is consistent with the Australian Consumer Law.

10. Liability

To the extent permitted by law, Aquaculture Kings is not liable for loss caused by:

  • misuse of a product
  • failure to follow instructions, warnings, or recommended procedures
  • improper storage, handling, or maintenance
  • unauthorised modification of a product
  • inaccurate information or measurements supplied by you
  • events outside our reasonable control, including courier delays, transport disruption, weather events, supply interruptions, or third-party service failures

Aquarium systems, livestock health, and culture outcomes depend on many variables outside our control, including water chemistry, husbandry, maintenance practices, contamination, system instability, and compatibility factors. To the extent permitted by law, we are not liable for loss arising from those external factors except to the extent the loss is caused by our breach of a non-excludable legal obligation.

11. Governing Law

These Terms are governed by the laws in force in Western Australia, Australia.

You and Aquaculture Kings submit to the non-exclusive jurisdiction of the courts of that State or Territory and of the Commonwealth of Australia.

12. Changes to These Terms

We may update these Terms from time to time by publishing the revised version on our website.

Any updated Terms will apply from the date they are published, but will not apply retrospectively to orders already accepted before that date unless required by law or expressly agreed.

13. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision is to be read down to the minimum extent necessary or, if that is not possible, severed. The remainder of these Terms will continue in full force and effect.
