Shipping policy
1. Where We Ship
Aquaculture Kings ships Australia-wide. International shipping may be available for selected products only. Where international shipping is available for a product, the available shipping options will be shown at checkout.
2. Processing and Dispatch
Orders are processed and dispatched as soon as reasonably practicable. Estimated processing and dispatch timeframes are indicative only and may vary due to order volume, stock availability, public holidays, carrier availability, weather events, or other circumstances outside our reasonable control.
3. Dispatch Schedule
Non-live orders may be dispatched on any business day.
Live-food orders, and any order containing live foods, are dispatched on Mondays and Tuesdays only, unless otherwise stated by Aquaculture Kings.
If a live-food order, or an order containing live foods, is placed outside the applicable dispatch window, the order will be held until the next available Monday or Tuesday dispatch day.
Live-food orders may still be dispatched on Mondays and Tuesdays where a public holiday falls within the relevant delivery period. By placing an order for live foods, you acknowledge and agree that it is your responsibility to use any shipping estimator, delivery estimate, or other information made available at checkout, or provided by the selected courier to assess whether the estimated transit time is acceptable to you before completing your purchase.
4. Live-Food Shipping Service
Live foods are shipped using Express or the fastest shipping service selected or made available by Aquaculture Kings for the delivery address provided.
Any reference to "Express" or similar service levels means the fastest available carrier option selected for that shipment and does not constitute a guarantee that the parcel will arrive within any specific timeframe, on any particular date, or without delay.
5. Tracking
Tracking details will be provided where the selected shipping service includes tracking. Once a parcel has been lodged with the carrier, it is your responsibility to monitor tracking updates and take any steps reasonably necessary to receive or collect the parcel promptly.
6. Authority to Leave and Collection Requirements
Unless otherwise stated at checkout, parcels may be sent with Authority to Leave.
If the carrier is unable to leave the parcel safely at the delivery address, the parcel may be redirected to a post office, depot, collection point, or other carrier facility for collection.
You are responsible for monitoring tracking information and, where applicable, collecting the parcel on the same day it becomes available for collection.
To remain eligible for any guarantee, live-arrival policy, or Dead on Arrival policy offered by Aquaculture Kings, the parcel must be successfully delivered on the first delivery attempt or, if redirected for collection, collected on the same day it becomes available, unless otherwise required by law.
7. Delivery Timeframes
Any delivery timeframe shown at checkout, in shipping estimates, or in communications from Aquaculture Kings is an estimate only.
Delivery times may vary depending on destination, carrier capacity, weather conditions, public holidays, regional or remote location constraints, and other circumstances outside our reasonable control.
Where public holidays, carrier congestion, weather events, or other external delays affect the transit time of a shipment, any claim under our Dead on Arrival policy or similar live-arrival guarantee will be assessed strictly in accordance with the terms of that policy and the circumstances of the shipment, subject always to your rights under applicable law. Businesses must still comply with consumer guarantees and cannot exclude rights that apply by law.
8. Shipping Costs
Shipping charges are calculated at checkout and may include postage, packaging, handling, and related fulfilment costs.
Shipping charges are non-refundable except to the extent required by the Australian Consumer Law or any other applicable law. Broad statements that delivery fees are never refundable may be unlawful in some circumstances.
9. Address Accuracy
You are responsible for ensuring that all delivery information provided at checkout is complete and accurate.
Aquaculture Kings is not liable for loss, delay, misdelivery, or additional costs arising from incorrect, incomplete, or outdated delivery information supplied by you.
Where a parcel is returned to sender due to an incorrect address, failed delivery, refusal of delivery, or failure to collect the parcel, any re-dispatch will be at your cost and subject to product suitability, stock availability, and payment of any applicable re-shipping fees.
10. Damaged Parcels
If your parcel arrives visibly damaged, you must take clear photographs of the outer packaging, shipping label, and contents immediately upon receipt and contact Aquaculture Kings as soon as possible, providing your order number and supporting images.
Failure to notify us promptly may affect our ability to investigate the issue with the carrier or assess the claim.
11. Carrier Delays
Once an order has been dispatched, delivery is performed by a third-party carrier. Aquaculture Kings is not responsible for delays caused by the carrier, including delays arising from carrier operational issues, transport disruptions, weather events, public holidays, or other events outside our reasonable control.
Nothing in this policy excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law, including where goods are not supplied within a reasonable time or where other consumer guarantees apply.
Where Aquaculture Kings elects to offer a replacement, resend, store credit, refund, or other remedy in circumstances not required by law, that remedy is offered on a case-by-case basis and at our discretion.
12. Contact
For shipping assistance, please contact Aquaculture Kings via the contact channels published on our website and include your order number and any relevant supporting information.
13. Australian Consumer Law
Nothing in this Shipping Policy excludes, restricts, or modifies any consumer rights, guarantees, or remedies that cannot be excluded, restricted, or modified under the Australian Consumer Law or any other applicable law. Under the ACL, consumers may be entitled to remedies such as repair, replacement, refund, cancellation, or compensation depending on the nature of the issue.
The version you had before was a bit dangerous because phrases like "sole discretion" and anything that sounds like "no claim regardless of the circumstances" can create trouble if they conflict with consumer guarantees. The rewrite fixes that.
